BREAST CANCER PATIENT RIGHTS

SICK PAY

Every patient who is registered with the General Regime of Social Security(INSS) can resort to the benefit. In other words, this occurs in situations in which the person is temporarily unable to attend work and carry out their activities.

For such, the condition must be proven by means of the presentation of exams conducted by the organ's medical examination. Particularly for individual taxpayers, such as liberal professionals and self-employed workers, among others, Social Welfare provides aid for the entire period of the illness.

FGTS

The Guarantee Fund for Time of Service(FGTS) can also be used by cancer patients or dependents affected by the disease. Therefore, the worker who has any kind of cancer or has dependents with the disease can withdraw the FGTS.

The withdrawal amount can be the total or partial amount the worker has in his/her account and it can be made several times - as long as there is a balance in the account. - as long as the symptoms persist.

The breast cancer patient can also request the release of the PIS/PASEP when requesting the release of the FGTS. Therefore, the documentation is the same required for the release of the FGTS and the requests must be made at a Caixa Econômica Federal (CEF) unit.

INCOME TAX EXEMPTION FOR RETIREES

Every cancer carrier is exempt from Income Tax regarding the incomes from retirement, retirement and pension - as well as their complements. It is also worth mentioning that the benefits are not taxed.

EXEMPTION FROM MISCELLANEOUS TAXES

For breast cancer patients they have exemption from other day to day taxes as well, such as:

  • ICMS;
  • IPI;
  • IPVA on the purchase of adapted vehicles.

The condition for the application for the last item on the list, in turn, starts from the moment in which the patient presents some kind of physical disability in the lower or upper limbs.

SETTLEMENT OF HOME LOANS

In cases of total and permanent disability, the rights of the cancer patient are also assured in this regard. The patient may request the discharge of the debt provided that she is unable to exercise her profession and that the disease was diagnosed after the signing of the property purchase contract.

FREE PUBLIC TRANSPORT

Breast cancer patients are entitled to a free ticket for public transport. This benefit, however, is not available to all cities in Brazil, as it depends on municipal legislation.

EXEMPTION FROM THE CAR ROTATION SYSTEM

The request for exemption from the car rotation is also among the rights of the breast cancer patient. To obtain the benefit, the patient must fill out a form, available at the Department of Road System Operation (DSV).
